The Specificity Critique
The Paradise Post decided to feature one the more ridiculous talking points on offer by anti-equality forces. The “Specificity Critique” is when bigots decry trans equality laws for being policy instead of procedure. I find it ironic the same people who decry the claimed tyranny of Big Government are the same who decry the fact that they aren’t micromanaged by the State in the roll-out of trans-inclusive policy. The specificity critique is the last fig leaf of a bigoted ideology. In what other arena of legal discourse must laws write in not only the policy, but also the procedure? The standard to which the Paradise Post appeals is not observed by other state laws. A law will set a policy. It is up to the agencies and/or local governing bodies to set the procedure to carry out the legal policy set forth a State Legislature. Shame on the Paradise Post
